NASCAR Adjusts Rule Book Amid Antitrust Dispute Involving 23XI, Front Row Motorsports

NASCAR has reportedly revised its rule book, a move that appears to be a direct response to the ongoing legal battle involving 23XI Racing and Front Row Motorsports. Both teams lost their charters earlier this year after filing an antitrust lawsuit challenging NASCAR’s charter system. With a federal judge recently denying their request for a temporary restraining order (TRO), the teams are now classified as open entries and must qualify for each race.

 

Although the court denied immediate relief, the ruling included a key note: the teams may reapply for a TRO if they face exclusion from a race due to field limitations. The judge suggested that such a scenario could meet the legal standard of “irreparable harm,” potentially allowing for temporary reinstatement of their charters.

 

NASCAR's updated rule book now explicitly states that it can, at its sole discretion, limit the number of entries for a race to 40. In such cases, the open team slots will be awarded based on team owner points standings. Another new provision confirms that up to six open teams can earn grid positions using this points-based criterion.

 

Last weekend at Dover Motor Speedway, both 23XI and Front Row competed as open teams in the Cup Series. In a twist of irony, 23XI co-owner Denny Hamlin claimed victory in the AutoTrader EchoPark Automotive 400, keeping his team in the spotlight despite the ongoing legal tension.

 

Speaking to reporters after the race, Hamlin addressed the lawsuit cryptically but firmly, indicating that more revelations will come during the trial scheduled for December 1. “All I can tell you... is that if you want answers and you want to understand why this is all happening, come December 1st, you’ll get the answer you’re looking for,” he said. “And all will be exposed.”
