FIFA's appeal committee has upheld the three-year ban on Luis Rubiales, the former head of the Spanish Football Federation (RFEF), after dismissing his appeal. Rubiales was initially banned on October 30, 2023, for engaging in behavior allegedly contrary to FIFA's principles, particularly Article 13 of the FIFA Disciplinary Code.
This ban followed an incident where Rubiales kissed player Jenni Hermoso on the lips without her alleged consent after Spain's Women's World Cup final win over England in August. The decision may still be subject to appeal before the Court of Arbitration for Sport.
In its statement, FIFA's Appeal Committee expressed its satisfaction that Rubiales had acted in a manner contrary to the principles outlined in Article 13 during and after the Women's World Cup final.
Rubiales, who had resigned from his position at RFEF in September, was notified of the committee's decision. Despite earlier vows to resist stepping down, Rubiales cited untenability in his position, influenced by pressure from players, politicians, and women's groups.
On a separate note, a Spanish High Court judge has recommended that Rubiales stand trial over the kiss, suggesting that the investigation indicated the act "was not consensual and was a unilateral and surprising initiative."
The judge also proposed trials for former women's team coach Jorge Vilda, men's team sport director Albert Luque, and federation marketing chief Ruben Rivera, all accused of pressuring Hermoso to state that the kiss was consensual.
