European court to reassess Caster Semenya's appeal against testosterone regulations

The European Court of Human Rights (ECHR) announced plans to review Caster Semenya's appeal against regulations mandating female athletes with elevated testosterone levels to undergo medication, scheduled for May 15. Semenya, a double Olympic champion from South Africa, previously won a legal battle against Switzerland at the ECHR last July, which ruled in her favor, citing discrimination from the Court of Arbitration for Sport in Lausanne.

 

Despite Semenya's victory, Swiss authorities, backed by World Athletics, have escalated the matter to the ECHR's Grand Chamber, with hearings set to commence in May. Semenya, recognized as having "differences in sexual development," has consistently rejected hormone-altering treatment since the regulations were introduced by World Athletics in 2018, leading to her exclusion from her preferred 800m distance and an unsuccessful transition to the 5,000m category.

 

Although the ECHR's ruling last year symbolically supported Semenya's cause, it did not challenge the validity of World Athletics' regulations nor grant her immediate reinstatement into competition without adherence to the medication requirement.

 

In her memoir, "The Race To Be Myself," Semenya acknowledged the end of her elite athletic career, shifting her focus towards advocating for young athletes confronting similar challenges. World Athletics introduced the DSD regulations to ensure fairness in women's events, requiring DSD athletes like Semenya to maintain blood testosterone levels below specified thresholds to compete in any distance events.
